1. Agreement to Terms
By accessing or using the services, digital products, consulting resources, and websites provided by Aka Aoi Security, you agree to be bound legally by these Terms of Service. If you do not agree to these terms, you must refrain from utilizing our systems or purchasing services.
2. Scope of Services
Aka Aoi Security provides specialized cybersecurity consultancy, including:
- Security Operations Center (SOC) telemetry monitoring and engineering support.
- Offensive security activities (Penetration Testing, Red/Purple Teaming).
- Regulatory compliance gap analysis (ISO 27001, SOC 2, NIS2, DORA).
- Secure software development and AI engineering services.
Each service engagement is governed by this framework, alongside specific Statements of Work (SoW) and Service Level Agreements (SLAs) executed directly between Aka Aoi Security and client representatives.
3. Acceptable Use and Authorization
When utilizing our websites or engaging our offensive security components, you represent and warrant that:
- You have full explicit authority to authorize testing on target environments and assets.
- You will not use our deliverables, techniques, or documentation to orchestrate malicious attacks, denial-of-service (DoS) attempts, or reverse-engineer proprietary security architectures.
- You will provide accurate scoping boundaries and immediately report any target changes.
4. Intellectual Property
Unless explicitly documented in a customized Statement of Work:
- Aka Aoi Security retains all rights, title, and ownership interest in core scripts, methods, software, AI evaluation frameworks, and reporting templates utilized or developed during the services.
- Clients receive a perpetual, non-exclusive, royalty-free license to use final security report deliverables solely for internal security remediation, compliance verification, and risk management.
5. Confidentiality
We operate under a strict "NDA-first" operational protocol. Both parties agree to protect all proprietary and confidential information disclosed during the engagement, utilizing at least the same degree of care they employ to safeguard their own highly sensitive operational materials.
6. Limitation of Liability and Disclaimers
Cybersecurity is a rapidly changing landscape. While we strive to meet the highest engineering and testing standards, our services are provided on an "as-is" and "as-available" basis.
Aka Aoi Security does not warrant that its services will identify 100% of all potential vulnerabilities, threats, or exploits. Under no circumstances shall Aka Aoi Security be held liable for indirect, incidental, or consequential damages (including data loss or business disruption) exceeding the total fees paid by the client for the specific service under dispute.
7. Governing Law
These terms are governed by and construed in accordance with the laws of India, without reference to conflicts of law principles. Any dispute arising out of or related to these terms shall be subject to the exclusive jurisdiction of the competent courts in India.
